When should I file a Special Leave Petition (SLP) in the Supreme Court?
An SLP is appropriate when you have received an adverse order from a High Court and wish to challenge it before the Supreme Court. The Supreme Court grants special leave to appeal at its discretion โ typically where there is a substantial question of law, a manifest injustice, or a conflict between High Courts. How long does an SLP or inter-state transfer petition take at the Supreme Court?
Inter-state transfer petitions are frequently decided within a few months and can be heard urgently. SLPs may be admitted and listed relatively quickly, but final disposal can take 1โ3 years or longer. Urgent matters โ especially child custody โ can be brought up for early hearing. We advise on realistic timelines for your specific apex court matter.
Can I get an interim stay on a High Court order while my Supreme Court SLP is pending?
Yes. Under Section 24 of the Hindu Marriage Act and Section 125 CrPC, you can apply for interim maintenance and litigation expenses even while the main case is pending. Yes. At the time of filing an SLP, you can simultaneously move for stay of the High Court order. The Supreme Court can grant interim relief โ including stay of divorce decrees, custody orders, or maintenance โ pending final disposal of the SLP. We regularly obtain such interim orders at the first or early hearing before the apex court.
I am an NRI โ can Vintage Litigation represent me at the Supreme Court without me attending hearings?
Yes. The Supreme Court is generally amenable to representation through a Power of Attorney and vakalatnama. In most SLP and transfer petition hearings, personal presence is not required.
