When should I file a case in the Delhi High Court rather than a family court?

The Delhi High Court is the appropriate forum when you want to challenge a family court or district court order by way of appeal, revision, or writ; when you wish to quash an FIR; when you need to transfer a case between courts; or when a contempt petition needs to be filed for non-compliance of a court order. How long does a first appeal or transfer petition take at the Delhi High Court?

Transfer petitions are often heard and decided within a few months. First appeals in matrimonial matters typically take 1–3 years depending on complexity and the High Court’s workload. Applications for interim stay or relief can be heard urgently. We advise on the realistic timeline for your specific type of High Court matter in the first consultation.

Can I get an interim stay on a family court order while my High Court appeal is pending?

Yes. Under Section 24 of the Hindu Marriage Act and Section 125 CrPC, you can apply for interim maintenance and litigation expenses even while the main case is pending. Yes. At the time of filing an appeal or revision, you can simultaneously move for a stay of the impugned order. The Delhi High Court can grant interim relief — including stay of divorce decrees, custody orders, or maintenance directions — pending final disposal of the appeal.
