What Matters Are Filed Before the Delhi High Court?
The Delhi High Court is not a court of first instance for matrimonial matters — it exercises appellate, revisional, and supervisory jurisdiction. Key matters heard here include first appeals against divorce decrees and family court orders; criminal revisions and applications for quashing of FIRs (especially in 498A and dowry cases); transfer petitions to move matrimonial cases between courts; writ petitions challenging orders of family courts or tribunals; contempt petitions for non-compliance of court orders; and bail applications in matrimonial criminal matters.
If you have received an unfavorable order from any family court or district court in Delhi, or wish to challenge an FIR, file a transfer petition, or approach the court by way of writ, the Delhi High Court is your forum. Questions About the Delhi High Court
When should I file a case in the Delhi High Court rather than a family court?
The Delhi High Court is the appropriate forum when you want to challenge a family court or district court order by way of appeal, revision, or writ; when you wish to quash an FIR; when you need to transfer a case between courts; or when a contempt petition needs to be filed for non-compliance of a court order. It is not a court of first instance for divorce or custody. Our team confirms the correct court for your specific address in the initial consultation.
How long does a first appeal or transfer petition take at the Delhi High Court?
Transfer petitions are often heard and decided within a few months. First appeals in matrimonial matters typically take 1–3 years depending on complexity and the High Court’s workload. Applications for interim stay or relief can be heard urgently. We advise on the realistic timeline for your specific type of High Court matter in the first consultation.
Can I get an interim stay on a family court order while my High Court appeal is pending?
Yes. Under Section 24 of the Hindu Marriage Act and Section 125 CrPC, you can apply for interim maintenance and litigation expenses even while the main case is pending. Yes. At the time of filing an appeal or revision, you can simultaneously move for a stay of the impugned order. The Delhi High Court can grant interim relief — including stay of divorce decrees, custody orders, or maintenance directions — pending final disposal of the appeal. We regularly obtain such interim orders at the first or early hearing.
I am an NRI — can Vintage Litigation represent me at the Delhi High Court without me attending every hearing?
Yes. Through a properly executed Power of Attorney, our team appears on your behalf at most Delhi High Court hearings. The High Court is generally more amenable to POA-based representation than family courts. We advise which specific hearings may require your personal presence and plan accordingly.
What documents should I bring for the first consultation?
Bring your marriage certificate, address proof for both spouses, any notices or correspondence exchanged, existing court orders (if any), and details of children and shared assets where relevant. Even with limited documents, the consultation is highly valuable — Adv. Karan Dua will guide you on exactly what to gather next.
